Statutory Sick Pay

All staff have entitlement to be paid Legal Sick Pay when absent from work. There are exceptions and these include : OAPs . Short term workers ( on contracts of a quarter or less ). Low paid who don't earn enough to pay State Insurance contributions.

New staff. Pregnant workers. Overseas workers. Captives . Staff on strike.
How much is Approved Sick Pay? The rate of Approved Sick Pay is worked out according to the employee's ordinary weekly revenues, this can define which band they fall into. As from Apr 1999 the rate of official sick pay is £59.55 per week for workers earning not less than the amount critical to be responsible to pay Countrywide Insurance Contributions. It's not owing for the 1st three qualifying days of the sickness, but is due afterward up to twenty-eight weeks. After that time a worker will need to claim state illness benefit. If a worker doesn't qualify for statutory sick pay they will still qualify for illness benefit from the DSS.

Legal sick pay will be paid by the employer and reclaimed from the state. Official sick pay is due at an once-per-week rate divided by the amount of qualifying days in that week. The qualifying days customarily follow the ordinary pattern of working days, as an example Monday to Fri. The qualifying days can however be less, but there should be one qualifying day per week. The employer and worker must agree on what the qualifying days will be and these are going to be included in the contract. If the contract doesn't spell out the qualifying days then if there's a challenge the court will generally select the ordinary working week. If this changes the court will select Wednesdays as the qualifying days. For example, if the worker works Monday to Fri. and those are the qualifying days and he falls sick on Tues. he will not claim till Fri. . If the employee's fourth day of sickness falls on one of the qualifying days then they can claim fifth of the once a week quantity of approved sick pay for that day of sickness. If Wed. is the sole qualifying day and the worker became ill on Wed. they could claim the full weekly amount for that days sickness. If however, they became ill on any other day aside from Wed. that might not claim anything. Actually most bosses will pay the worker their standard pay during times of illness as a part of their contract.
